Guys i have hit a snag with purchasing Gen 3 tubes, unless the end user is US mil.
I was wondering if anybody knows a company that could help us out.
My boss and company are very keen to get this purchase done.
regards
OZE.

Oze,
You're asking if a company can legally assist you in purchasing these items. Correct?

If you run afoul of ITARS, your company and even management staff could be in trouble with the authorities....

There are maybe 3 or 4 countries that we can export GEN III stuff to, and solely for MIL applications. I doubt this is going to happen (legally).
Anything with a Figure Of Merit above ~1200 is not exportable.

Ask ITT, payers of a $100M fine for selling SWITCHES and various other non technical items to the Chinese. NO tubes, systems, or technology.

Actually if they are on legit Gov't contract then they can get and EUC approved by the contracting officer representative. I recently went through a similar process for similar items. Just be advised that there is paperwork to be done and it can take a while. The company selling the stuff should be familiar with the process. I believe it will run through the BIS, Office of Exporter Services.

I recently went through a similar process for similar items....I do not mean to be either argumentative or condescending, but the issuance of an EUC by your DOD rep is NOT the finality of your ITARS requirements.
More than a few companies are, or have been, in problems with DOS because they thought they had the approval of the govt via their DOD client....

SOTB,
I understand that. But when applying for the EUC there should be enough people around who can advise of the exact procedures, as well as the company shipping the stuff. But, w/o getting approval to even bring the stuff in country nothing is going to happen. Our stuff went through DoS, BIS and all the other acronyms.

I will agree to that, as I don't know anything different. That being said, any night vision with a FOM greater than ~1200 (GEN III) won't be exported. I was just at the Night Vision Manufacturers conference on Wednesday and there was a very boring but informative brief by the head of DTSA.

All I know is that we have GEN 3 optics and there was an attachment that stated that the end user was in support of DoD/ DoS contracts and that there could be no further transfer of the items once they were received, etc..etc...If I can find some of the docs I see about redacting and posting or at least trying to get the specifics.

That makes sense, if you are in support of US DoD/DoS. I am thinking the above dude is not in support of US operations. It isn't considered an export if ownership isn't transferred to a foreign entity.
Of course, every rule has its exception.

SB- that is correct, Company that we are trying to purchase through has Stated that end user must be US MIL,(for export use).
Company staff is very new at purching equip and so am I.But i have been asked to do it.
We are in support of MOD, DOD and DOS. Which the company we have asked for a qoute from, said that it would still not allow us to purchase as we are not US MIL.

You can shoot me an email at aric.sherwood AT us.army.mil and I will try to get a call back to you Monday. I need to know the particulars and then can develop a course of action, or tell you it isn't going to happen at any rate.
