View Full Version : Apartment residents told to take down U.S. flags or face eviction

Normally, I don't post this kind of thing... but this just got under my skin.
It is just idiotic. I can see saying, "you can't drill holes in the building to mount a flag" Makes sense... it is private property. But to say, you can't have a flag sticker on your car in the parking lot because it might hurt someone's feelings?
I thnk it is inteesting that the Apt manager seems to have made that decision... not the owner. Will be interesting to see how that plays out once some people vote with their rent money.

I love this bit:
Resident we talked to who had been approached to take down their flags all told us the same thing: that management told them the flags could be offensive because they live in a diverse community
Diverse... like with people of different views and backgrounds and opinons? Some of whom are proud of their country? or did they mean diverse in a different way? ;)
Second article with more information: http://democratherald.com/news/local/article_d7d3c902-b4ee-11de-b11b-001cc4c03286.html
edit: yes, it is private property and the owner of the apartment can do what he/she wants... that doesn't make them smart.

That crazy diversity, sort of like a melting pot...or sometimes even tired huddled masses.

I was thinking the same thing. Probably should toss all images of the Statue of Liberty as well... might be offensive to those who aren't poor or seeking liberty... and tyrants, wow... tyrants are right out!

This is definitely a stupid and dare I say offensive regulation, but the owner certainly has the authority to do it. I manage shopping centers as part of my job and we can and do tell tenants to take down advertising signs that they always try to put up on the property that do not comply with the sign regulations stipulated in the lease.

Thank God I don't have this confusing problem in my country.
All public housing estates in my country have in-built hooks to hang flags. every national day in my country, residents hang out their flags:

I honestly don't understand how the US Flag could be considered offensive.

Really, and if they are offended by it.....why the hell are they here in the first place???

The apartment manager can't tell you to take an American Flag sticker off your car. It's protected speech, no different then an Obama sticker on the bumper.
I see this complex getting a new manager soon.

Ahh, but look where it is, Portland, OR. This is the city that had anti-war protests where they burned soldiers in effigy. News of this sort coming out of that city does not surprise me.

After all this publicity, this is the only thing I see happening.

If this went to court they would have to apply the same standard to every rainbow flag, Obama sign, etc.etc as well. I'd like to see them try that. If this were really fought I would like to think they'd have a hard time. However I would'nt be suprised if they didn't.
As far as the owner being able to do what he wants. That's not always true. I know in Fl there is a whole set of laws dealing with just that. When a property is rented the woner surrenders certain rights and obligations. There's a whole laundry list of things that the owner/landlord can get in trouble for trying to force on their tenants. I believe there is even a specific provision dealing with flying an American flag within certain limitations.

I thought I remembered something like this. I'd be suprised if all the other states (except California and NY) did'nt have a similar law.
RESIDENTIAL TENANCIES (ss. 83.40-83.682) (http://www.flsenate.gov/statutes/index.cfm?App_mode=Display_Statute&Search_String=&URL=Ch0083/SEC67.HTM&Title=->2009->Ch0083->Section%2067#0083.67)
4) A landlord shall not prohibit a tenant from displaying one portable, removable, cloth or plastic United States flag, not larger than 4 and 1/2 feet by 6 feet, in a respectful manner in or on the dwelling unit regardless of any provision in the rental agreement dealing with flags or decorations. The United States flag shall be displayed in accordance with s. 83.52(6).

Un-fucking-believable!
So, the manager, Barb Holcomb, says that they've "had previous problems with this sort of thing." Exactly what kind of "thing" is she talking about and what kind of problems?
And the associate director of the Oregon ACLU, Jann Carson, says that nobody's civil rights are being violated unless there's a "racial motivation" for the ban. Huh? So, now my rights of freedom of speech, assembly, etc. can only be violated if there's a racial motivation behind the encroachment?
I'm glad that the ACLU has cleared this little matter up. It would certainly be beyond the pale to expect the ACLU to defend such anti-social behavior as flag-waving in the courts. It’s good to know that’s not protected speech.
(Unless of course, I want to fly a Mexican flag as a demonstration of my support for La Raza. That would be racially motivated and protected. So, the ACLU would stand up for me then, I guess.)
Barb and Jann are idiots! What's worse, they're dangerously empowered idiots imposing their Orwellian world view others. Double speak and wrong think on both of them!
I hope one or more of the residents forces this into the courts. Of course, in Oregon, that'd probably be a losing proposition.
This is a sad, sad commentary on the state of affairs in America.

Proposed new verse for the national anthem:
"O, say, can you see, anywhere flown outside,
What so proudly we hailed and displayed with such pride?
Whose broad stripes and bright stars, once so nobly admired,
Feared by tyrants afar, must be now sheathed and retired.
'Fly it no more outside,' said a few with false pride,
'For it just might offend those among us, new friends.
O say, does that star-spangled banner yet wave
O'er the land where they are free, yet we must make amends.

From the article posted by Gackman"He's just a romping, stomping patriot," Holcomb said.
Anyone else think she wasn't complimenting him on his 'patriotism' for this country?

With the implementation of the Panama Canal Treaty, the US colors on Gulick were lowered for the last time. The old 3/7 guys will remember. The Bn Commander at the time had to give the hardest order he ever made (per him): All US flags in quarters and POVs, etc, has to come down/off. How would you liked to have given that order?

In my neck of the woods, you are more likely to see the Mexican flag flying from someone's house than the American flag... :frown:
And some businesses fly both the Mexican flag as well as the American flag but the Mexican flag is flown higher.

This wouldn't have happened on the east side of the Cascades. I've gotten the rare query about the highly polished brass mezuza on my doorframe now and then ("Is that part of your security system?" — "Well, one could put it that way...."). In both instances, the persons posing the question were Mormon missionaries, but never once has there been a single complaint from the landlord.

That's what is strange... it isn't even Portland. It is Albany... the redneck bedroom comunity of the state capitol.
